Accessory Dwelling Unit Amendment

Public Hearing set for August 1, 2017

TRAVERSE CITY, MICHIGAN- The Traverse City Planning Commission has scheduled a Public Hearing for August 1, 2017 at 7:00 p.m. to consider a possible amendment to the City’s accessory dwelling unit (ADU) ordinance as recommended by the Planning Commission’s Housing and Building Committee. As defined in the City’s zoning ordinance, “accessory dwelling unit means a smaller, secondary home on the same lot as a principal dwelling. Accessory dwelling units are independently habitable and provide the basic requirements of shelter, heating, cooking and sanitation.”

The Planning Commission asked that the public hearing notice be promoted by the city to ensure that the citizenry is aware of the possible amendment. The amendment proposes several changes to the existing ADU ordinance for single-family districts, expands ADU’s to the R-2 district and introduces a license requirement that is renewed annually and offers a defined complaint process. This amendment includes an accessory building size reduction, eliminating the minimum ADU size requirement and elimination of the ADU 5,000 sq. foot lot area requirement. There is no recommended change to the allowed quantity of ADU’s allowed per year, which is 10 per calendar year.

Since 2015, the City has permitted 10 ADU’s per year for a total of 30 permitted ADUs.

Demand: In 2015, all 10 ADU permits were issued within a week of the ADU ordinance enactment. There was a waiting list for ADU’s that was created in 2015 and on January 1, 2016, all 10 permits for 2016 were issued. On January 1, 2017, there were 8 on a wait list and by February 8, 2017, all 10 permits for 2017 were issued. There are currently five requests for ADU’s on a wait list for 2018.

Types of ADUs: In 2015, there were three new detached garages with upper level ADUs, five second story remodels of existing detached garages, one conversion of an existing Temporary ADU and one interior remodel of a detached building from a play room to an ADU. In 2016, there were five new detached garages with upper level ADUs and five second story remodels of existing detached garages. In 2017, there are four new detached garages with upper level ADUs, three second story remodels of existing detached garages and three ADUs added to existing homes.

Complaints: To date, there have been no complaints or issues with the permitted ADUs.

Of the 30 permitted ADU’s, 15 have achieved a certificate of occupancy (C of O). The remainder are either under construction or have not yet begun construction. Land Use permits expire after 24 months if not 75% complete or 36 months if not 100% complete.

The public is invited to review the draft ordinance amendment at the Planning Department. The public is also invited to voice opinions by attending the public hearing or by sending comments to the Planning Commission, by mail at 400 Boardman Avenue, Traverse City, Michigan 49684, or email at planningcommission@traversecitymi.gov stating reasons for approval or disapproval.
